1. About Optimise

Optimise is a digital health platform operated by [Optimise Your Healthtd], a company incorporated in Hong Kong (the "Company", "we", "us", "our").

The platform enables users to upload, store, track and analyse laboratory results and other health-related information and may provide digital health insights and AI-assisted analysis tools.

Optimise does not provide emergency medical services.

2. Acceptance of Terms

By creating an account or using the platform, you agree to be bound by these Terms of Service.

If you do not agree, you must not use the platform.

3. Eligibility

You must be at least 18 years old to use the platform.

You are responsible for ensuring that all information provided is accurate and up to date.

4. Nature of Services

Optimise provides:

  • Digital storage of personal health data
  • Laboratory result tracking
  • Health dashboards and scoring tools
  • AI-assisted analysis tools
  • Access to licensed healthcare practitioners where applicable

Unless expressly stated, Optimise provides informational and analytical tools only and does not replace professional medical diagnosis or treatment.

Users are responsible for consulting qualified healthcare professionals before making medical decisions.

5. AI-Assisted Tools

Optimise may use artificial intelligence systems to analyse laboratory results and generate health insights.

AI-generated outputs:

  • Are assistive in nature
  • May not be error-free
  • Do not constitute medical diagnosis unless reviewed by a licensed practitioner

You acknowledge and accept the limitations of AI-assisted analysis.

6. User Responsibilities

You agree:

  • To provide truthful and accurate information
  • Not to upload false, misleading, or fraudulent medical data
  • To maintain confidentiality of login credentials
  • Not to misuse or attempt to compromise platform security

7. Intellectual Property

All platform content, software, scoring methodologies, and analytical systems are owned by or licensed to Optimise.

Users retain ownership of their personal and medical data.

8. Suspension and Termination

We may suspend or terminate accounts:

  • For breach of these Terms
  • For misuse of services
  • To comply with legal or regulatory obligations

Users may terminate their account at any time, subject to applicable medical record retention obligations.

9. Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law:

The platform and all content, tools, analytics, AI-generated outputs, health scores and insights are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

Optimise makes no representations or warranties regarding the accuracy, completeness, reliability, suitability, or availability of any information or health-related output generated through the platform.

You acknowledge that:

  • The platform provides informational and analytical tools only;
  • AI-generated outputs may contain errors or inaccuracies;
  • Any health decisions made based on platform content are made at your sole risk.

Optimise shall not be liable for:

  • Any medical decisions, treatments, or actions taken or not taken based on platform information;
  • Any indirect, incidental, consequential, special, punitive, or exemplary damages;
  • Loss of profits, data, goodwill, or business opportunity.

To the extent liability cannot be excluded but may be limited, Optimise's total aggregate liability shall not exceed the total fees paid by you (if any) during the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Hong Kong.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

However: Nothing in these Terms shall limit any mandatory rights you may have under applicable consumer protection, healthcare, or data protection laws in your country of residence.

11. Regulatory Compliance Across Jurisdictions

Optimise may operate across multiple jurisdictions in Southeast Asia and other regions.

Users acknowledge that:

  • Local healthcare regulations may apply depending on location
  • Data protection laws may apply based on user residence
  • Where required by mandatory local legislation, such laws shall prevail.
